LuxuryMatch Kenya (“we,” “us,” or “our”) provides a private matchmaking and curated dating service for adults seeking genuine relationships. By using our website, submitting an application, or engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

1. Eligibility

By using our services, you confirm that:

• You are at least 18 years of age.
• You are legally capable of entering into a binding contract.
• You are seeking a genuine relationship, friendship, or dating connection.
• You are not using our services for commercial purposes, prostitution, sexual services, or any illegal activity.

2. Account and Application

To access our matchmaking services, you must submit an application through our website or in person. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of any credentials and for all activities that occur under your account. We reserve the right to refuse, suspend, or terminate your access if we suspect any violation of these Terms.

3. Nature of Services

LuxuryMatch is a matchmaking and social dating service. We facilitate introductions between consenting adults. We do not:

• Guarantee that any introduction will lead to a relationship, marriage, or romantic connection.
• Provide sexual services, paid companionship, prostitution, or any form of sexual arrangement.
• Provide hotel rooms or accommodations for sexual purposes.

Our dates are designed for two people to meet in public or agreed venues and have a genuine conversation. What happens thereafter is entirely up to the individuals.

4. Fees and Payments

All fees for our services are clearly communicated on our website or during consultation. You agree to pay the applicable fees for the service you select. Payment is due before the service is rendered. We do not accept cash payments for security reasons; all payments are processed through our secure payment gateway. Refunds are subject to the cancellation policy below. We reserve the right to change fees with reasonable notice.

5. Cancellation and Refund Policy

If you wish to cancel a booked date or experience, please notify us at least 48 hours in advance to receive a full refund. Cancellations made within 48 hours may be subject to a cancellation fee or forfeiture of the full amount, at our discretion. No-shows are not refunded. In the event that we cannot arrange a suitable match after reasonable efforts, we may offer a refund or credit toward future services, as determined by our team.

6. Conduct and Responsibilities

You agree to treat all participants and our staff with respect and courtesy. You must not:

• Harass, threaten, or abuse any person you meet through our service.
• Share another member's personal information without their explicit consent.
• Photograph, record, or broadcast any interaction without consent.
• Use our service for illegal or fraudulent purposes.

We reserve the right to terminate your membership if you violate these standards or engage in any conduct that we deem inappropriate or harmful.

7. Verification and Identity

We take reasonable steps to verify the identity and authenticity of our members. However, we cannot guarantee that all information provided by members is accurate or complete. You are encouraged to exercise good judgment and personal responsibility in all interactions. We are not liable for any false or misleading information provided by another member.

8. Privacy and Confidentiality

Your privacy is important to us. Our collection and use of your personal data are governed by our Privacy Policy. By using our services, you consent to our privacy practices. We will not share your information with third parties except as described in our Privacy Policy or with your consent.

9. Intellectual Property

10. Disclaimers and Limitation of Liability

Our services are provided “as is” and “as available.” We make no warranties, express or implied, regarding the success of any match or the conduct of other members. To the fullest extent permitted by law, LuxuryMatch Kenya shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our services. Our total liability, whether in contract, tort, or otherwise, shall not exceed the amount you paid us in the six months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless LuxuryMatch Kenya, its directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your use of our services, your violation of these Terms, or your violation of any rights of another person.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Kenya. Any dispute arising out of or relating to these Terms or our services shall be resolved through friendly negotiation first. If negotiation fails, the dispute shall be submitted to the exclusive jurisdiction of the courts of Kenya.

13. Changes to These Terms

We may update these Terms from time to time. The latest version will be posted on this page with the effective date at the top. By continuing to use our services after changes, you accept the updated Terms.
